Welcome to Mainstream. These Terms and Conditions (“Terms”) govern your access to and use of the Mainstream website, applications, software, and related technology services (collectively, the “Application” or “Services”).

By accessing, purchasing, installing, or using the Services, you acknowledge that you have read, understood, and agree to these Terms.

1. Nature of the Service

Mainstream is an application-based technology and software service.

Mainstream provides application-based technology only and is not a content producer, content provider, or owner of third-party content.

The Application provides software functionality that may allow users to access, organize, display, or play media from sources available to or supplied by the user or independent third parties.

Mainstream does not claim ownership of third-party television programs, movies, channels, streams, broadcasts, feeds, playlists, or other media that may be accessed using the Application.

Mainstream does not acquire ownership of third-party content merely because that content may be accessed, displayed, streamed, or played using the Application.

2. Third-Party Content and Services

The Application may be technically capable of interacting with content, playlists, feeds, URLs, credentials, servers, APIs, accounts, or other resources supplied by users or independent third parties.

Mainstream does not own, produce, upload, create, license, manage, or exercise editorial control over third-party content loaded into or accessed through the Application.

Third-party content and services are independent from Mainstream. The availability of functionality within the Application that can display, organize, access, or interact with third-party content does not constitute ownership, sponsorship, endorsement, licensing, authorization, or distribution of that content by Mainstream.

Mainstream makes no representation or warranty concerning the ownership, licensing status, legality, accuracy, quality, reliability, security, suitability, or continued availability of third-party content or services.

Mainstream cannot control third-party content and is not responsible for what independent third parties make available or what an individual user chooses to load, access, stream, display, or view through the Application.

3. User-Loaded Content and User Responsibility

Users are solely responsible for the content, sources, playlists, URLs, feeds, credentials, accounts, servers, or other third-party resources they choose to load, connect, access, or use with the Application.

Mainstream does not control what individual users choose to load, access, display, stream, or view through the Application.

Users are responsible for ensuring that they have any rights, permissions, licenses, subscriptions, accounts, or other authorization required to access or use third-party content.

Users agree not to knowingly use the Application to access, reproduce, distribute, transmit, display, stream, or otherwise use content in violation of applicable law or the intellectual property rights of another person or entity.

Mainstream is solely the creator and provider of the application technology and does not own or control third-party content. Any content, playlist, feed, URL, credential, source, account, server, or other third-party resource that a customer chooses to load, connect, access, stream, display, or view through the Application is selected and used at the customer’s own responsibility.

Mainstream cannot control such third-party content and, to the fullest extent permitted by applicable law, assumes no responsibility or liability for the content itself or for the customer’s decision to access, load, stream, display, or view it.

To the fullest extent permitted by applicable law, Mainstream is not responsible or liable for claims, losses, damages, disputes, copyright issues, licensing issues, intellectual property claims, legal violations, or other consequences resulting from third-party content selected, supplied, loaded, accessed, streamed, displayed, or viewed by a customer.

The customer’s use of third-party content through the Application is at the customer’s own risk and responsibility. Mainstream’s role is limited to providing and maintaining the application technology.

4. Eligibility and Acceptable Use

You must be at least 18 years old, or the applicable age of majority in your jurisdiction, to purchase or use the Services.

By using the Services, you agree to:

  • Provide accurate and current account and billing information.
  • Use the Application only for lawful and personal purposes.
  • Comply with applicable copyright, intellectual property, and other applicable laws.
  • Maintain the security of your account credentials.
  • Use only content and third-party resources that you have the right or authorization to access.
  • Refrain from interfering with, damaging, reverse engineering, exploiting, or attempting unauthorized access to the Application or its supporting systems.

Mainstream may suspend or terminate application access for violations of these Terms or suspected fraudulent, abusive, unauthorized, or unlawful use.

5. Account Access and Security

You are responsible for maintaining the confidentiality and security of your username, password, and other account credentials.

You are responsible for activity occurring through your account and should promptly notify Mainstream if you believe your account or credentials have been compromised.

Accounts and application access may not be resold, commercially redistributed, or shared beyond the limitations of the subscription purchased.

6. Subscriptions, Billing and Cancellation

Mainstream operates using prepaid subscription plans for access to its application technology and related Services.

By enrolling in a recurring subscription, you authorize Mainstream and its payment processor to charge your selected payment method according to the billing frequency selected at checkout.

There are no required long-term contracts unless expressly stated at the time of purchase. Customers may cancel recurring billing before their next renewal date to prevent future renewal charges.

Cancellation stops future renewals and does not ordinarily result in a prorated refund for an already-paid subscription period, except where required by applicable law or expressly provided by Mainstream’s refund policy.

7. Application Availability and Third-Party Dependencies

Mainstream works to maintain reliable application functionality but does not guarantee uninterrupted or error-free operation.

Application performance may be affected by factors outside Mainstream’s control, including internet connectivity, device compatibility, operating-system changes, third-party servers or services, network congestion, geographic restrictions, third-party policies, and changes made by independent third parties.

Mainstream does not guarantee that any particular third-party content, source, feed, playlist, channel, program, server, account, API, or service will remain accessible or compatible with the Application.

Changes, interruptions, restrictions, suspension, removal, or discontinuation of third-party content and services are outside Mainstream’s control.

Mainstream is not responsible for interruptions, buffering, changes in availability, removal of content, third-party server failures, or other issues caused by services, networks, or resources not owned or controlled by Mainstream.

8. Intellectual Property

The Mainstream name, branding, logos, website design, proprietary software, application interfaces, code, documentation, and other materials created and owned by Mainstream are protected by applicable intellectual property laws.

Your subscription provides a limited, personal, non-exclusive, non-transferable right to use the Application in accordance with these Terms. It does not transfer ownership of Mainstream’s software, technology, branding, or intellectual property to you.

Third-party trademarks, programming, media, logos, content, and other intellectual property remain the property of their respective owners.

The appearance, accessibility, compatibility, organization, display, or playback of third-party content through the Application does not imply ownership, licensing, sponsorship, endorsement, authorization, or affiliation by Mainstream.

9. Prohibited Activities

You may not use the Services to:

  • Engage in unlawful activity.
  • Knowingly infringe the copyrights, trademarks, or other intellectual property rights of others.
  • Access or use third-party content without any authorization required by applicable law.
  • Compromise or attempt to compromise the security of the Application.
  • Circumvent technical restrictions imposed by Mainstream.
  • Resell or commercially distribute application access without authorization.
  • Introduce malware, malicious code, or other harmful software.
  • Interfere with the operation of the Application or supporting infrastructure.

Mainstream reserves the right to suspend or terminate accounts used in violation of these Terms.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Application and Services are provided on an “as is” and “as available” basis.

Mainstream does not guarantee that the Application will operate without interruption, be compatible with every device or third-party service, or provide continuous access to resources controlled by independent third parties.

Mainstream expressly disclaims responsibility for the acts, omissions, content, availability, ownership, licensing, legality, security, accuracy, quality, or operation of independent third parties.

Mainstream does not make any warranty or representation that third-party content accessed through the Application is authorized, licensed, accurate, legal, suitable, secure, or continuously available.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Mainstream and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages resulting from the use of or inability to use the Application.

This includes, where permitted by law, losses, claims, or damages arising from third-party content or services, service interruptions, buffering, device incompatibility, internet connectivity, user-selected or user-loaded content, unauthorized account access, copyright disputes, licensing disputes, or actions taken by independent third parties.

Mainstream has no control over third-party content selected, supplied, loaded, connected, accessed, streamed, displayed, or viewed by users and, to the fullest extent permitted by applicable law, assumes no responsibility or liability for such content or for a user’s decision to access, load, stream, display, or view it.

Responsibility for selecting, accessing, and using third-party content rests with the customer. Mainstream’s responsibility is limited to the application technology that it creates and provides.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Mainstream and its owners, employees, contractors, affiliates, and service providers from third-party claims, damages, liabilities, losses, costs, and reasonable expenses arising from:

  • Your unlawful use of the Application.
  • Your violation of these Terms.
  • Your infringement of another party’s rights.
  • Content, playlists, feeds, URLs, credentials, accounts, servers, or other third-party resources that you choose to supply, load, connect, access, distribute, stream, display, or use through the Application.
  • Your failure to obtain any rights, permissions, licenses, subscriptions, or authorization required for third-party content you choose to access or use.

13. Changes to the Application or Terms

Mainstream may update its Application, software functionality, policies, or these Terms from time to time.

When these Terms are materially updated, the revised version and effective date will be published on this page.

Your continued use of the Services following an applicable update constitutes acceptance of the revised Terms to the extent permitted by law.

14. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will remain in full force and effect.
